General terms and conditions

1. Definitions

The following definitions apply in these general terms and conditions:

• Principal: any natural or legal person who has entered into a contract for the provision of services.
• Agent: DBA Services Sàrl, registered office 39 Sous Géronde, 3960 Sierre, enterprise identification number CHE-424.102.314

2. Scope

These general terms and conditions apply to all contractual relations binding the Principal and the Agent for items of service provision.

3. Contract period

The contract enters into force when the first order is placed via the website. It is made for a minimum period of 1 (one) month and is then renewed automatically for 6 (six) months. It can be terminated in writing (email or letter sent by ordinary mail) by either of the parties, giving at least two complete calendar months’ notice.

4. Prices and terms and conditions of payment

A. The price displayed when an order is placed is to be understood as the price for each operation and given in Swiss francs (CHF). It can be paid on a monthly basis thereafter.

B. The service provision is to be paid for in advance and payment must be received at least 3 working days before the service is scheduled to be provided.

C. The price can be amended in accordance with the Swiss Consumer Price Index and/or the collective labour agreement applicable to the business sector. If the price is amended, a notice is sent and must be agreed in advance by the Principal.

D. In the event of a service being cancelled, no reimbursement is made because the service includes a staff booking and travel, which cannot be cancelled after payment has been made.

5. Access to the services

The Agent reserves the right to refuse to provide services to a potential client without stating its reasons for doing so.

6. Obligations related to fulfilment of the contract

A. The Agent makes available to the Principal staff who are equipped and trained to perform the tasks specified in the contractually-agreed items of service provision.

A1. The equipment, products and machinery necessary to the performance of the work are provided by the Agent.

A2. The following are made available to the Agent free of charge: the water (hot and cold) and electricity necessary to the performance of its tasks on the Principal's premises.

A3. The Agent undertakes to comply with current legislation and the applicable collective labour agreement.

A4. The Agent may adjust its prices if the order and/or the place are inconsistent with the item of service provision ordered, in particular as regards the description of the rooms.

B. The Principal undertakes to comply with these general terms and conditions.

B1. The Principal must pay for the service provision in advance, failing which the service provision may be cancelled without creating any entitlement to claim compensation from the Agent.

B2. Where a service is cancelled without notice within 3 working days of the scheduled time for the service provision, no reimbursement will be made and no compensation can be claimed.

7. Data protection

The Agent undertakes not to disclose any personal data to third parties without the written agreement of the Principal.

8. Amendments

The Agent reserves the right to amend these general terms and conditions at any time. The amendments will be accessible on the Agent's website.

9. Place of jurisdiction and applicable law

All contractual relations are subject to the law of Switzerland.

The place of jurisdiction is Lausanne, Switzerland.
